Another Loss for Nicole Cole via Forfeit

Former Spotsylvania County School Board member and state delegate Nicole Cole lost another court battle via forfeit. Here is the press release from the Founding Freedoms Law Center and a statement by former school board member Lisa Phelps

“As the former elected School Board member for the Lee Hill District of Spotsylvania County, Va. I am issuing the following statement after former Spotsylvania School Board member Nicole Cole voluntarily dismissed her $1 million lawsuit yesterday.. Cole was recently elected to serve as a member of the Virginia House of Delegates, representing portions of Caroline County and Spotsylvania County. I think our citizens will be more informed in two years and reject the radical progressive antagonist.

I am pleased—but not surprised—that this frivolous lawsuit has now been voluntarily dismissed. From the beginning, this case was frivolous and non factual merit. The court had already dismissed all five claims on demurrer, making clear that the accusations against me were baseless.

This lawsuit should never have been filed. It wasted time, resources, and public attention that should have been focused on serving our students, teachers, and families. Attempts to use the legal system to silence or intimidate individuals for speaking truthfully about public meetings and public conduct undermine trust in our institutions.

I consistently acted responsibly and truthfully while serving as an elected official, and yesterday’s voluntary dismissal fully vindicates me.

Although my term on the Spotsylvania School Board concluded at the end of 2025, I remain committed to civic engagement and to supporting transparency and accountability in public service. Thank you to those who always believed in me and supported me. To those who believed the radicals, naysayers and media, I hope you do a deep dive into facts instead of allowing the intentional false media optics steer you.
